1. DESCRIPTION OF THE WEBSITE ASTROLEKHA.COM: ASTROLEKHA.COM offers astrological content, reports, data, telephone and email consultations (the “Content”) via the Internet and email. To access the personalised astrological zone and/or to get extra Content and services from astrolekha.com (the “Paid Services”), You may be required to register as a member of astrolekha.com. The Free Services and Paid Services are jointly referred to as the “Services” in these Terms of Service. In exchange for Paid Services, Member undertakes to: (1) submit certain current, complete, and accurate information about Member when requested to do so by astrolekha.com, and (2) maintain and update this information as necessary to keep it current, complete, and correct. In these Terms of Service, “Registration Data” refers to all the information We seek and You submit during first sign-up, as well as any subsequent revisions. Numerous Services and Content are provided by third-party vendors, not astrolekha.com.

3. MEMBER REGISTRATION DATA: Upon registering, you will receive an astrolekha.com identity (“YOUR EMAIL ID”) and a password. You are solely responsible for maintaining the secrecy of your astrolekha.com e-mail address and password. You are liable for any uses of Your account, whether permitted by you explicitly or not. You can change Your password by following the on-site instructions. You agree that Your account, EMAIL ID, and password cannot be sold or transferred to a third party. You promise to alert astrolekha.com promptly of any unauthorised use of Your account or any other known security violation.

OUR ACCESS TO YOUR ACCOUNT: To ensure that astrolekha.com is able to provide high-quality services, respond to customer needs, and comply with applicable laws, You consent to astrolekha.com employees and agents having case-by-case access to Your account and records to investigate complaints or other allegations or suspected abuse.
5. MODIFICATION OF SERVICES; BREACH; TERMINATION: astrolekha.com may change or discontinue (in whole or in part) the Services or Your account with us, with or without notice and for any reason, and without responsibility to You, any other user, or any third party. Without limiting the foregoing, We reserve the right to immediately terminate Your account (a) if We are unable to verify or authenticate Your Registration Data or other information provided by You, (b) if We believe that Your actions may expose You, astrolekha.com, or all or some of Our other users to legal liability, or (c) if We believe You have I provided us with false or misleading Registration Data or other information, (ii) interfered with other users or the administration of
Privacy is very important to us; thus, Our Privacy Policy, as it may be revised from time to time and as it appears on the Website, is incorporated by reference into these Terms of Service. Our Privacy Statement may be modified periodically in accordance with the terms for modifying these Terms of Service (as described in the Preamble above).
7. REFUND AND CANCELLATION POLICY: Detailed Return and Cancellation Policy Service
Only refund requests sent to customercare@astrolekha.com within two hours of payment will be accepted. No refunds will be issued after two hours have passed after the moment of payment.
If the customer’s information is inaccurate, no refund will be granted. However, if the consumer sends us an email within an hour of ordering the report, we will consider making the requested adjustments.
Once the report has been sent to the client, there shall be no refunds.
All qualified refunds must be processed within seven business days of request receipt. However, this is subject to bank/payment gateway transaction and processing times.
In the event of an accidental double payment for a single order, one payment will be returned.
All refunds will be issued after deducting the bank and/or payment gateway transaction fees, as well as any additional fees incurred by astrolekha.com in processing and/or delivering the service, as applicable.
Product with a Complete Return and Cancellation Policy
All printable items are non-returnable, including the astrolekha Brihat Horoscope, astrolekha Year Book, Trikal Samhita, and Janam Patri.
If a product is damaged, defective, or broken, the client may request a replacement or a refund. For this, customers may email customercare@astrolekha.com within two business days of product delivery. No refunds will be accepted after two days have passed from the date of goods delivery.
All products must be returned in their original condition, along with any invoices and/or labels. Within two days of delivery, the customer must submit photographs of broken/defective/damaged merchandise through email to customercare@astrolekha.com. Disputes filed beyond two days following delivery may not be considered by sellers.
In the event of an accidental double payment for a single order, one payment will be returned.
All refunds will be issued after deducting the transaction fees levied by the bank and/or the payment gateway, the cost of shipping or courier fees (both ways), customs duty, and/or any other fees incurred by astrolekha.com in processing and/or providing the service, as applicable. However, none of the foregoing shall be recovered if the refund is due to a damaged/defective/broken product.
8. MEMBER BEHAVIOR AND RESTRICTIONS; COMPLIANCE WITH LAWS: Your right to use the Services is an individual one. You affirm that You are a natural person and not a corporation or other business entity. You agree not to resell or otherwise use the Services for commercial purposes without the prior written authorization of astrolekha.com. You alone are responsible for the content of any transmissions made over Our Website. All local, state, national, and international laws and regulations apply to your use of the Services. You agree: (1) to comply with all Indian laws concerning the transmission of technical data exported from India via the Service; (2) not to use the Website or the Services for illegal purposes; (3) not to interfere or disrupt networks connected to astrolekha.com; (4) to comply with all applicable regulations, policies, and procedures of networks connected to the astrolekha.com Website; and (5) to comply with all applicable domestic and international laws, statutes, ordinances, and regulations. Due to the fact that astrolekha.com uses the Internet to send and receive some messages, Your conduct is subject to Internet legislation, policies, and procedures. You agree not to use astrolekha.com for chain letters, junk mail, spamming, or any other type of distribution lists to any individual who has not given express permission to be included in such a process. You undertake not to communicate through astrolekha.com any anything that is unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable. You also undertake not to submit any content that could constitute a criminal offence, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law or regulation. Unauthorized attempts to access other computer systems are prohibited. You shall not interfere with the use or enjoyment of the Website or Services by any other astrolekha.com member.
9. NO WARRANTY. YOU AGREE AND ACKNOWLEDGE THAT:

ASTROLEKHA.COM IS NOT RESPONSIBLE FOR THE AVAILABILITY (OR LACK THEREOF), TIMELINESS (OR LACK THEREOF), DELETION, MISDELIVERY, OR FAILURE TO STORE ANY MEMBER COMMUNICATIONS OR PERSONALIZATION SETTINGS; (B) IN PARTICULAR, BUT NOT LIMITATIVELY, ASTROLEKHA.COM MAY DELETE E-M NO ADVICE OR INFORMATION OBTAINED BY YOU FROM ASTROLEKHA.COM OR THROUGH THE SERVICES, WHETHER ORAL OR WRITTEN, SHALL CREATE ANY WARRANTY.
10. LIMITATIONS OF LIABILITY. IN NO EVENT WILL ASTROLEKHA.COM OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS AND THE COST OF PROCURING SUBSTITUTE GOODS AND SERVICES (COLLECTIVELY, “INDIRECT DAMAGES”) ARISING OUT OF OR IN CONNECTION WITH OUR ASTROLEKHA.COM AND ITS SUPPLIERS ARE NOT LIABLE FOR INDIRECT DAMAGES ARISING OUT OF OR IN CONNECTION WITH: (A) THE USE OR INABILITY TO USE THE SERVICES; (B) ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH ASTROLEKHA.COM’S SITE, OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH ASTROLEKHA.

(C) THE LOSS, UNAUTHORIZED ACCESS TO, OR ALTERATION OF TRANSMISSIONS OR DATA OF A USER.
ASTROLEKHA.COM AND ITS SUPPLIERS’ LIABILITY TO YOU OR ANY THIRD PARTY ARISING OUT OF OR IN CONNECTION WITH OUR WEBSITE, THE SERVICES, OUR PRIVACY POLICY, OR THESE TERMS OF SERVICE (HOWEVER ARISING, INCLUDING NEGLIGENCE) IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAID TO US IN THE TWELVE (12)
You agree to indemnify, defend, and hold harmless astrolekha.com and its parent, subsidiaries, affiliates, officers, directors, employees, suppliers, consultants, and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorneys’ fees) arising from Your use of the Services, Your violation of the Privacy Policy or these Terms of Service, or Your violation of any third party’s rights. These Terms of Service will benefit the successors, assigns, and licensees of astrolekha.com.
You acknowledge that the Content, which includes but is not limited to text, software, music, sound, photographs, video, graphics or other material contained in either sponsor advertisements or distributed via email, commercially produced information presented to Member by astrolekha.com, its suppliers, and/or advertisers, is protected by copyrights, trademarks, service marks, patents and/or other proprietary rights and laws. Unless expressly authorised by astrolekha.com, its suppliers, or advertisers, you may not copy, use, reproduce, distribute, perform, display, or make derivative works from the Content.
13. NOTICES. Except as expressly provided differently in these Terms of Service, all notices to a party shall be in writing and shall be delivered by email or conventional mail. Notice must be deemed given twenty-four hours after an email is delivered, or three days following deposit in the mail, to Member at the address provided by Member in the Registration Data and to astrolekha.com at the address listed below: A-726, Kamla Nagar, Agra (UP), India.
14. ARBITRATION; INJUNCTIVE RELIEF. Any dispute, controversy, or claim arising out of, relating to, or in connection with this Agreement shall be resolved by binding arbitration in accordance with the norms for commercial arbitration in the Indian Law. The arbitration shall be conducted by a single arbitrator selected in accordance with the rules of Indian law, and any court with jurisdiction may enter judgement on the arbitration award. Regardless of the foregoing, either party may seek interim or preliminary relief from a court of competent jurisdiction in Agra in order to protect its rights pending the completion of any arbitration hereunder, and both parties consent to the exclusive jurisdiction of the courts of India and venue in Agra, Uttar Pradesh for any such proceeding. If any party violates this provision by filing a lawsuit, the other party may recover up to $1,000 in attorney fees and costs.
15. GENERAL PROVISIONS: These Terms of Service shall be governed by and construed in accordance with the laws of India, except any principles of conflicts of law that would necessitate the use of the laws of a different state. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms of Service or Privacy Policy to be unenforceable or invalid, such provision shall be changed and interpreted so as to achieve the goals of such unenforceable or invalid provision within the limits of applicable law, and the remainder of the Terms of Service or Privacy Policy, as applicable, shall remain in full force and effect.
